India has been growing relentless since Pakistan’s Prime Minister Imran Khan’s visit to US and what added to their dismay was US President Donald Trump’s proposition of acting as mediator or even an arbitrator to resolve Kashmir issue. This statement elicited the uproar of Indian politicians demanding explanation from Prime Minister Narendra Modi to provide explicit explanation of President Donald Trump’s statement about Indian Prime Minister urging US to act as a mediator to Kashmir issue. Since this statement India has been vehemently denying the occurrence of such discourse and adamantly asserts that Kashmir is an internal issue and no foreign intervention will be welcomed or appreciated whatsoever, but the damage has been done, and India in order to remedy this damage to BJP’s reputation, has taken a step to abolish article 370 and article 35A from constitution that grants special autonomous status to Kashmiri’s, giving them freedom to rule under their own designed laws and subsequently Article 35A provides them the right to their property as no outsider can buy land in Kashmir under no circumstances.
This move will change the existing law and will render Indians the opportunity to buy land in Kashmir or should I say will give them the opportunity to evict Kashmiri’s of their Land. What India wants is doing is refurbishing of Israel’s policy to outnumber Palestinians in their own territory, by strategically placing their civilian population into Kashmir’s Muslim populated area to expel indigenous population and illegally occupying and controlling their territory.
This strategy has been employed by Israeli forces twice. Once in 1948 and second time recently in 2019 and seems to be working quite well for them, but this strategy requires using military forces to subjugate and suppress any dissension and even resorting to lethal means which could unequivocally lead to either a mass Exodus or Genocide. History has seen genocide such as one being planned by India to ethnically cleanse an area to forcefully occupy it Bosnian massacre and Armenian genocide are examples of such genocide.
Placement or transferring part of civilian population into territory that a country has forcefully occupied is complete violation of International Law. Under Geneva Convention Article 49, sixth paragraph:
“The occupying Power shall not deport or transfer parts of its own civilian population into the territory it occupies”
Additional Protocol 1
Article 85(4) (a) of the 1997 Additional Protocol 1 provides that:
“The transfer by the occupying power of parts of its own civilian population into the territory it occupies” is grave breach of protocol.
ICC statute:
Under article 8(2) (b) (viii) of the ICC statute:
“The Transfer, directly or indirectly, by the occupying power of parts of its own civilian population into the territory it occupies”
Constitute a war a crime in international conflicts.
Not only what India is doing is grave violation of international law but also has dire ramifications as placing or transferring local civilian population could change the demographic balance of Kashmir and could in future lead to bloody confrontation between transferred population and indigenous population, as indigenous population could perceive the transferred one as subjugators of their basic rights, and transferred population could deem indigenous population as violent majority that is unwelcoming of change this abomination could result in something like Rwandan genocide of 1994.
India’s move to abolish article 370 and Article 35A finds its root in the indoctrination of BJP (Bhartiye Janta Party) and RSS (Rashtriya Swayamsevakh Sangh) plan to annex Kashmir and make it, its own territory by either making it, its own province or Union Territory (UT). Old pictures of Narendra Modi have been circulating which elucidates Narendra simmering desires to violate Kashmiris constitutional right. The process to abolish article 370 and 35A subsequently requires crushing any resistance whatsoever and that requires militarization of that particular region. Modi government has deployed 10,000 more troops in Kashmir region nearly 700,000 Indian troops are already deployed in Kashmir region. A violent oppressive, fascist, nationalist and authoritarian regime with 700,000 troops against beleaguered, bereaved, subjugated and deprived people full of honour, integrity and valour ready to face any odds for their freedom and self-determination is a recipe for genocide and disaster.
But Indian government seems to care any less. They already started enforcing draconian laws and placed several Kashmiri leaders under house arrest such as Chief Minister Mehbobha Mufti and Omar Abdullah. Indian right wing leaders and parties have completely supported Modi governments move to abolish Article 370 while left wing parties have criticized it as encroachment of their basic rights. Pakistan’s Prime Minister has unequivocally shown his support for Kashmir’s people and Pakistan’s Ministry of Foreign Affairs issued statement on Article 370,
“As the party to this international dispute, Pakistan will exercise all possible options to counter the illegal steps. Pakistan reaffirms its abiding commitment to the Kashmir issue”
Border skirmishes have seen an upsurge in recent days. Whether India inches towards genocide or Exodus this move towards the persecution of beleaguered Kashmiri’s could lead to a war with Pakistan. Currently a war of any sort between these rivaling countries could easily turn nuclear which could subsequently lead this South Asian region towards Nuclear Holocaust. So both countries should show maximum restraint on their behalf or foreign nations or International forces should intervene before something catastrophic like Bosnian Massacre or Rwandan genocide happens to plunge South Asian region into dark abyss of war and desolation.
