ISLAMABAD:Election Commission of Pakistan (ECP) has full power of exercising contempt of court right under section 10 of the Election Act, 2017.
A spokesman of ECP Haroon Khan Shinwari in a clarification on the contempt of court case against Chairman Pakistan Tehreek-e-Insaf (PTI) Imran Khan said that the ECP has similar right of contempt of court as the High Court has under article 204 of the constitution.
He said that ECP members have also same right on the matter as High Court judges have on contempt of court subject.
He said that the counsel and legal experts didn’t inform Imran Khan about actual situation.
Due to this situation a confusion was created as first Imran Khan’s counsel rendered apology and then withdrawal from apology.
He added but when show cause notice was issued to Imran Khan there was no mention of apology or any regret in his reply which was declared ECP as unsatisfactory and issued his arrest warrant.
He said that the confusion could be avoided on informing actual situation of case hearing to Imran Khan by his counsels.
He made it clear that the ECP has full right of contempt of court under section 10 of new law while it had similar power under old ROPA law. APP
